OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of a fall: On or about June 12, 2018, at the site, an employee was performing welding operations while standing on the midrail of a Sky Jack (Model SJ III-3219) scissor lift up to approximately 8 feet high, exposing the employee to a fall hazard .

29 CFR 1926.502(d)(16)(iii): Personal fall arrest systems, when stopping a fall, were not rigged such that an employee could not free fall more than 6 feet (1.8 m) nor contact any lower level: On or about June 12, 2018, at the site, employees were performing welding work while standing on the mid rail of the boom lift and scissor lift although the employer had written safety rules addressing such conduct. The fall protection lanyards were anchored several feet below the D-ring on the harness and would allow more than 6 feet of free fall or swing fall hazards into the equipment and building. The employee was exposed to fall hazard.
