On or about July 12th, 2018, at the jobsite located at 351 NE 185th Street. Miami, FL 33179, at the Riggings department, the employer did not verify that an employee using a NIOSH approved filtering N95 half face piece 3M respirator #8511 and a reusable elastomeric half face 3M # 7503, was medically able to use that respiratory protection.

29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible: On or about July 12th, 2018, at the jobsite located at 351 NE 185th Street. Miami, FL 33179, at the Riggings department, the employer did not train and provide the employees with the information contained in Appendix D of this standard for the use of NIOSH approved filtering N95 half face piece 3M respirator #8511 and reusable elastomeric half face 3M # 7503, regarding the requirement of the proper maintenance and storage of the respirators.
