29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent.    a) On or about February 20, 2020, at the jobsite located at 351 NE 185th Street Miami, FL 33179, an employee working as a sander/buffer in lamination area was exposed to continuous noise at 76.6 % which exceeds the action level of 50% (an 8-hour time weighted average (TWA) sound level of 85 dBA for instituting a hearing conservation program. The 8-hour TWA sound level was approximately 88.2 dBA during the 427 minute sampling period.  Exposure calculations included a zero increment for the 53 minutes not sampled.    b) On or about February 20, 2020, at the jobsite located at 351 NE 185th Street Miami, FL 33179, an employee working as a sander/buffer in lamination area was exposed to continuous noise at 106.1% which exceeds the action level of 50% (an 8-hour time weighted average (TWA) sound level of 85 dBA for instituting a hearing conservation program. The 8-hour TWA sound level was approximately 90.4 dBA  during the 428 minute sampling period.  Exposure calculations included a zero increment for the 52 minutes not sampled.

29 CFR 1910.134(d)(1)(i): The employer shall select and provide an appropriate respirator based on the respiratory hazard(s) to which the worker is exposed in the workplace and user factors that affect respirator performance and reliability.  On or about February 20, 2020, at the jobsite located at 351 NE 185th Street Miami, FL 33179, the employer did not select appropriate type respirators for employees who had facial hair for religious purposes, were wearing 3M elastomeric half mask respirators while performing sanding/painting operations.

29 CFR 1910.134(g)(1)(i)(B): Respirators with tight-fitting facepieces were worn by employees with a condition that interfered with the face-to-facepiece seal or valve function:  On or about February 20, 2020, at the jobsite located at 351 NE 185th Street Miami, FL 33179, the employer did not ensure that employees correctly wore respirators in that employees were wearing respirators with the straps of the respirators on the outside of hoods for head covering. The wearing of a respirator in this manner prevents the respirators from forming an effective seal and allows the employee to inhale contaminants.
