29 CFR 1910.178(l)(6): The employer did not certify that each operator has been trained and evaluated as required by this paragraph (l) of 29 CFR 1910.178:  (a) New residential construction on Lot #31, East side: On or about 07/25/2018, and at times prior, the employer allowed employees to operate rough terrain powered industrial forklift trucks without certification, evaluation, and training on the type of truck they were operating.

29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use:  (a) New residential construction located on #31, East side: On or about 07/25/2018, and at times prior, The employer exposed employees to fall hazards of over 26-feet to the lower ground level, in that an employee was working from a makeshift work platform which was not approved or designed to be used with the Genie GTH-1056 All-Terrain Forklift Truck. The platform used was designed to store debris and not as a work platform attachment.

29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied:  (a) New residential construction located on Lot #31, East side: On or about 07/25/2018, and at times prior, the employer exposed employees to fall hazards of over 26-feet to the lower level, in that the makeshift work platform was not secured to the forks to prevent accidental movement during framing activities as this equipment was used as a elevated scaffold attachment.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section:  (a) New residential construction located on Lot #31, East side: On or about 07/25/2018, and at times prior, the employer exposed employees to falls over 26-feet to the lower level, in that at fall protection system was not provided to employee working from a makeshift personnel platform resting on the forks to a Genie All-Terrain Forklift Truck.
