29 CFR 1926.651(e): Exposure to falling loads. No employee shall be permitted underneath loads handled by lifting or digging equipment. Employees shall be required to stand away from any vehicle being loaded or unloaded to avoid being struck by any spillage or falling materials. Operators may remain in the cabs of vehicles being loaded or unloaded when the vehicles are equipped, in accordance with 1926.601(b)(6), to provide adequate protection for the operator during loading and unloading operations. a. On or about August 17, 2018 at the job site located across from 1506 S Oneida St Appleton, WI 54915, the employer did not ensure that an employee was protected from struck-by hazards from the bucket of a John Deere 350D LC Excavator. The employee was standing inside a trench shield while the excavator moved a load of gravel directly over the employee's head and delivered the gravel inside the trench shield behind the employee. b. On or about August 17, 2018 at the job site located across from 1506 S Oneida St Appleton, WI 54915, the employer did not ensure that an employee was protected from struck-by hazards while moving the trench shield as it was suspended by the excavator. The employee was standing inside a trench shield while the excavator moved the shield from South end of the trench to the North end of the trench.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems shall be made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection shall be conducted by the competent person prior to the start of work and as needed throughout the shift. Inspections shall also be made after every rainstorm or other hazard increasing occurrence. These inspections are only required when employee exposure can be reasonably anticipated. a. On or about August 17, 2018 at the job site located across from 1506 S Oneida St Appleton, WI 54915, the employer did not perform an inspection of the excavation , adjacent area, and protective system after the rainstorm that occurred during the afternoon.

29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c). a. On or about August 17, 2018 at the job site located across from 1506 S Oneida St Appleton, WI 54915, the employer did not ensure that the employee working on the storm water pipes was protected from cave-ins in a trench that was approximately 5.5' deep. The upper half of the employee's body was outside of the shield as he was working on the connection joint of the piping which exposed him to approximately four feet of unprotected trench walls on either side of the manhole box.
