29 CFR 1926.651(j)(1): Adequate protection shall be provided to protect employees from loose rock or soil that could pose a hazard by falling or rolling from an excavation face. Such protection shall consist of scaling to remove loose material; installation of protective barricades at intervals as necessary on the face to stop and contain falling material; or other means that provide equivalent protection. On or about July 24, 2024, at a jobsite located at the corner of corner of Bluemound Dr. and College Ave., in Grand Chute, Wisconsin, on the east and west faces of the trench, steel sheets did not cover the entire excavation face exposing employees to struck by hazards.

29 CFR 1926.652(d)(2): Manufactured materials and equipment used for protective systems shall be used and maintained in a manner that is consistent with the recommendations of the manufacturer, and in a manner that will prevent employee exposure to hazards. On or about July 24, 2024, at a jobsite located at the corner of corner of Bluemound Dr. and College Ave., in Grand Chute, Wisconsin, the employer utilized a trench shield in a manner that was inconsistent with the manufacturer's recommendations of not applying any lateral pressure against the spreader bars. The employer placed steel sheets on a trench edge that had a seam potentially applying lateral pressure to the spreader bars in the event of a collapse as they did not span from shield end to shield end.

29 CFR 1926.652(g)(1)(ii): Shields shall be installed in a manner to restrict lateral or other hazardous movement of the shield in the event of the application of sudden lateral loads. On or about July 24, 2024, at a jobsite located at the corner of corner of Bluemound Dr. and College Ave., in Grand Chute, Wisconsin, the employer did not back fill the area on the sides of the trench shield to prevent movement prior to the employee entering the trench to bind the two stacked trench boxes together.
