1926.651(k)(2) Where the competent person finds evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees shall be removed from the hazardous area until the necessary precautions have been taken to ensure their safety. On or about October 2, 2025, at a worksite located at 502 S Clark Street, Black Creek, Wisconsin, the employer did not ensure that a competent person was performing the required inspections of the trench excavation. The foreman onsite failed to identify engulfment hazards associated with an employee working from inside a 10 feet deep trench of Type C soil.

29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when excavations are made entirely in stable rock; or excavations are less than 5 feet (1.52m) in depth and examination of the ground by a competent person provides no indication of a potential cave-in. On or about October 2, 2025, at a worksite located at 502 S Clark Street, Black Creek, Wisconsin, the employer did not ensure that an employee conducting pipe laying inside a 10 feet deep trench of Type C Soil was protected against potential engulfment hazards when the trench was not provided with cave-in protection.
