29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system:    (a)Graff Roofing, Inc. at 5100 South Louise Avenue, Sioux Falls, SD 57108:  On or about and at times prior to October 29, 2018, the employer did not ensure that each employee was protected from falls from heights in that four employees were conducting roofing operations on a flat roof with no protective system in place.  This condition exposed the employees to a fall hazard of approximately 15 feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:    (a)Graff Roofing, Inc. at 5100 South Louise Avenue, Sioux Falls, SD 57108:  On or about and at times prior to October 29, 2018, the employer did not ensure that each employee engaged in roofing operations on a commercial property, had been trained to recognize the hazards associated with working at elevations over 6'. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. Employees working on-site had not received fall protection training before working at elevations over 6 feet.  The condition exposed employees to the hazard of falling from an elevation of approximately 15 feet.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:     (a)Graff Roofing, Inc. at 5100 South Louise Avenue, Sioux Falls, SD 57108: On or about and at times prior to October 29, 2018, the employer did not develop and implement a written hazard communication program which at least described how the criteria specified for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also included a hazardous chemicals list and methods used to inform employees of the hazards of non-routine tasks.  Among other chemicals, employees were potentially exposed to Versico G200SA Yellow Substrate Adhesive which contains toluene, xylene, and acetone.      Abatement Note:  The requirements applicable to construction work under 29 CFR 1926.59 are identical to those set forth at 29 CFR 1910.1200 of this chapter.
