29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following: Guardrail systems, safety net systems, or personal fall arrest systems. On or about October 29, 2018, employees were exposed to a fall of approximately 49 inches while performing yearly shutdown maintenance on the scrubber machine located on the roof of 34199 Curtis Blvd., Eastlake, Ohio 44095. The employees were working on all areas of the raised platform and the employer did not ensure that the employees were protected from falling off of the platform.

29 CFR 1910.28(b)(3)(i): The employer did not ensure each employee is protected from falling through any hole (including skylights) that is 4 feet (1.2 m) or more above a lower level by one or more of the following: covers, guardrail systems, travel restraint systems, or personal fall arrest systems, as required by sub-items A through D of this section. On or about October 29, 2018, an employee fell approximately 49 inches through a hole in a platform that was approximately 39 inches long and 39 wide while performing repairs on the scrubber machine located on the roof of 34199 Curtis Blvd., Eastlake, Ohio 44095. The employee was working on all areas of the raised platform and the employer did not ensure the employee was protected from falling.
