29 CFR 1910.1028(c)(2): Short-term exposure limit (STEL). The employer did not assure that no employee was exposed to an airborne concentration of benzene in excess of five (5) ppm as averaged over any 15 minute period: a) On November 9, 2018, in the POSM 1 unit, the employer did not monitor for airborne concentrations of benzene to which employees may be exposed during remediation of a spill after transfer of mixed hydrocarbons from the emergency flare knock out drum at the POSM 1 unit. b) On November 9, 2018, and times theretofore, in the POSM 1 unit, the employer did not monitor for airborne concentrations of benzene to which employees performing sampling may be exposed, including but not limited to: non-closed-loop sampling locations, including contents of a tank trailer containing mixed hydrocarbons from the emergency flare knockout drum, and pooled material in containment areas around that trailer.
