29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) 101 Route 70 East, Evesham construction site, southeast area of structure, 4th floor:  Employees without proper fall protection were working at heights between approximately 10-30' while installing the flooring structure for the 4th floor of a multistory apartment complex, on or about 02/04/2019;  b) 101 Route 70 East, Evesham construction site, southwest area of structure, 3rd floor:  Employee, with one foot on the 4th step of a Werner Type 1, 8' fiberglass step ladder and the other foot on the top rail for the deck opening, without fall protection was exposed to an approximate 22' fall to the ground, while attaching a piece rough trim, estimated at 1" x 6" x 6' wide, on or about 02/04/2019.  Rosen General Contractors, Inc. was previously cited for a Serious violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1360120, citation number 1, item number 3 and was affirmed as a final order on 01/08/19, with respect to a workplace located at St. Joseph's Age-Restricted Community, New Falls Road, Fairless Hills PA.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
