29 CFR 1926.451(h)(1): Each employee on a scaffold was not provided with additional protection from falling hand tools, debris, and other small objects through the installation of toeboards, screens, guardrail systems, or through the erection of debris nets, catch platforms, or canopy structures that contain or deflect the falling objects.  For falling objects too large, heavy or massive to be contained or deflected, the employer did not place and secure such potential falling objects away from the edge of the surface from which they could fall.    Exterior: Employees engaged in masonry work were exposed to struck by hazards where toe boards were not installed on the scaffold, on or about 2/20/2019.

29 CFR 1926.452(c)(5)(iii): Brackets used to support cantilevered loads shall be used only to support personnel, unless the scaffold has been designed for other loads by a qualified engineer and built to withstand the tipping forces caused by those other loads being placed on the bracket-supported section of the scaffold.    Exterior: Employees engaged in masonry work were exposed to fall hazards from scaffold collapse where materials were stored on brackets used to support cantilevered loads designed to support personnel only, on or about 2/20/2019.

Exterior: Employees engaged in masonry work were exposed to fall hazards while working on a welded framed scaffold that was not protected by guard rails, personal fall arrest system, safety nets, or other feasible means of fall protection, on or about 2/20/2019.    Alexander Paiva Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.451(g)(1), which was contained in OSHA inspection number 1176092, citation number 01, item number 002A and was affirmed as a final order on 2/03/2017, with respect to a workplace located at 407 Halsey Street, Newark, NJ.
