29 CFR 1926.404(f)(6): The path to ground from circuits, equipment, or enclosures was not permanent and continuous:    a) On or about 4/16/19, in the Electric Room on apartment building construction site at 1166 Jefferson Avenue, Buffalo, NY: A Makita Model MAC5200 air compressor supplied air to operate the powered nailers that employees were using to install Tyvek Commercial Wrap on the east side of the building exterior from the basket of an aerial lift. The plug on the cord of the compressor lacked a ground prong.      NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.453(b)(2)(v): A safety harness with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:    a) On or about 4/16/19, on apartment building construction site at 1166 Jefferson Avenue, Buffalo, NY: Two employees were installing Tyvek Commercial Wrap on the east side of the building exterior from inside of the elevated basket of a JLG Model 660SJ aerial lift. Both employees were wearing full body harnesses, but neither was tethered to the boom or basket of the lift. The employees were exposed to potential fall of approx. 30 ft.     NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:    a) On or about 4/16/19, on apartment building construction site at 1166 Jefferson Avenue, Buffalo, NY: Originally, doorway wall openings to balconies on the 2nd and 3rd floors were guarded by a wooden guardrail system consisting of a top rail and a midrail to keep unauthorized employees from accessing the balconies. To gain entrance to the balconies to install the windows, employees removed the guardrails, then used a personal fall arrest system while on the balconies installing the windows. However, when the window installation was completed, only the top rails were put back in place. This created a hazard where other unauthorized employees on the site could walk onto the unguarded balconies.     NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed:      a) On or about 4/16/19, on apartment building construction site at 1166 Jefferson Avenue, Buffalo, NY: An employee was standing on the sixth rung of an unopened Werner 8 ft. fiberglass stepladder that was setting on the ground and propped against the wall at the southeast corner of the building, while he was installing Tyvek Commercial Wrap on the wall. The stepladder was not designed to be used in this manner.       NO ABATEMENT CERTIFICATION REQUIRED
