29 CFR 1910.1000(e): To achieve compliance with paragraphs (a) through (d) of this section, administrative or engineering controls must first be determined and implemented whenever feasible. When such controls are not feasible to achieve full compliance, protective equipment or any other protective measures shall be used to keep the exposure of employees to air contaminants within the limits prescribed in this section. Any equipment and/or technical measures used for this purpose must be approved for each particular use by a competent industrial hygienist or other technically qualified person. Whenever respirators are used, their use shall comply with 1910.134. [71 FR 16673, April 3, 2006] On or about April 30, 2019, the employer did not implement sufficient engineering controls to keep the exposure of employees to below 50 ppm Carbon Monoxide during the work shift. An employee filling cracks and knot holes in lumber was exposed to 440% of the 8-hour Time Weighted Average Carbon Monoxide exposure limit of 50 ppm. The employee's calculated 8-hour Carbon Monoxide Time Weighted Average was 223.8 ppm.

29 CFR 1910.1200(h)(3)(i): Methods and observations that may be used to detect the presence or release of a hazardous chemical in the work area (such as monitoring conducted by the employer, continuous monitoring devices, visual appearance or odor of hazardous chemicals when being released, etc.); On or about May 2, 2019, the employer did not provide employees with methods and observations that may be used to detect the presence or release of Carbon Monoxide in the work area. Employees were exposed to levels at or above the PEL due to a PIV in the workplace that was not running properly.

Employee training shall include at least: The physical, health, simple asphyxiation, combustible dust, and pyrophoric gas hazards, as well as hazards not otherwise classified, of the chemicals in the work area: On or about May 2, 2019, employees working in a warehouse had not been trained on the hazards associated with carbon monoxide produced from the internal combustion engine of the LP powered industrial vehicles used to move product.
