29 CFR 1926.28(a): Appropriate personal protective equipment was not worn by employee(s) in all operations where there was exposure to hazardous conditions: a) Location - 605 West Walnut St. Lancaster, PA 17603 On or about May 16, 2019, the excavator operator was not wearing a seatbelt while operating equipment. b) Location - 605 West Walnut St. Lancaster, PA 17603 On or about May 16, 2019, a laborer was not wearing his hardhat while working within the arc of the moving excavator boom. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records. ------------------------------------------------------------------------------------------------------------ PER INFORMAL SETTLEMENT AGREEMENT ON 9/25/19 - INSTANCE A WITHDRAWN
