29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems. (a) On or about June 26, 2019, at the jobsite located at Fountain Mesa Road between Kansas Ave and Ohio Ave, the employer, Native Sun Construction, exposed employees to cave-in hazards while working in unprotected trenches that had not been evaluated for hazards by a competent person on site. The first trench was 8.9 feet and the second trench was 5. 2 feet deep where an employee was exposed and requiring a protective system.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). (a) On or about June 26,2019, the employer, Native Sun Construction, did not ensure its employees were protected from cave-in hazards while working in two trenches on Fountain Mesa Road between Kansas Ave & Ohio Ave, in Fountain, CO. Trench site one was measured at 8.9 feet in depth and trench site two was measured at 5.2 feet in depth.
