29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: a) On August 5, 2020, an employee was working in an unprotected trench exceeding 7 feet in depth when the trench wall collapsed. The trench was composed of loose granular soil and was showing signs of fissures. The competent persons permitted the employee to work inside the trench with the hazardous conditions present and without an adequate protective system. The employee was engulfed and suffered bruises on his left hip, rib cage, and shoulder. Abatement Note: Abatement certification and documentation is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c): a) On August 5, 2020, an employee was working in an unprotected trench exceeding 7 feet in depth when the trench wall collapsed. The trench was not equipped by an adequate protective system. The employee was engulfed and suffered bruises on his left hip, rib cage, and shoulder. Abatement Note: Abatement certification and documentation is required for this item (see enclosed "Certification of Corrective Action Worksheet"). The (employer name) was previously cited for a violation of this occupational safety and health standard or its equivalent standard (name previously cited standard), which was contained in OSHA inspection number 1411342, citation number 1, item number 1b, and was affirmed as a final order on July 17, 2019, with respect to a workplace located at Fountain Mesa Rd, Ohio Avenue & Kansas Ave, Fountain, CO 80817.
