29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.    7 Stafford Place at 28W703 Mount St., Warrenville, Illinois 60555 - on or about June 29, 2019, employees were exposed to at least 14 feet fall hazards when walking on the roof to access the peak and edges for job setup because fall protection and/or prevention systems were not used prior to starting work.    Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1926.502(d)(15): Anchorages used for attachment of personal fall arrest equipment shall be independent of any anchorage being used to support or suspend platforms and capable of supporting at least 5,000 pounds (22.2 kN) per employee attached, or shall be designed, installed, and used as follows:  - as part of a complete personal fall arrest system which maintains a safety factor of at least two [per 1926.502(d)(15)(i)]; and, - under the supervision of a qualified person [per 1926.502(d)(15)(ii)]:   7 Stafford Place at 28W703 Mount St., Warrenville, Illinois 60555 - on or about June 29, 2019, the flat-mounted temporary anchors used as part of personal fall arrest systems were not installed in accordance with the manufacturer's specifications, in that the minimum number of fasteners were not in place. The anchorage was not capable of supporting at least 5,000 pounds in the event of employee's fall. Employees were exposed to at least 14 feet fall hazards.  Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1926.502(d)(16)(iii): Personal fall arrest systems, when stopping a fall, be rigged such that an employee can neither free fall more than 6 feet (1.8 m), nor contact any lower level;  7 Stafford Place at 28W703 Mount St., Warrenville, Illinois 60555 - on or about June 29, 2019, employees engaged in residential roofing work were exposed to at least 14 feet swing fall hazards likely to result in serious injury where the self-retracting lifelines and flat-mounted temporary anchors were not properly applied. Employees were working in a swing fall position with the lifelines extended beyond a fall distance. An anchor with insufficient number of fasteners was laterally loaded by an employee tied-off to it at the extended distance.  Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1904.4(a): Basic requirement. Each employer required by this Part to keep records of fatalities, injuries, and illnesses must record each fatality, injury and illness that:    1. is work-related per 29 CFR 1904.4(a)(1); and,    2. is a new case per 29 CFR 1904.4(a)(2); and,    3. meets one or more of the general recording criteria of �1904.7 or the application to specific cases of ��1904.8 through 1904.12 per 29 CFR 1904(a)(3).    On or about June 29, 2019, the employer failed to record a work-related injury that occurred on February 14, 2019, and did not maintain required OSHA 300 form "Log of Work-Related Injuries and Illnesses."     Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1904.39(a)(2): The employer did not report an in-patient hospitalization, amputation, or loss of an eye as a result of a work-related incident to OSHA within twenty-four (24) hours.    1988 McThurstan Ct. in Saint Charles, Illinois 60174: on or about February 14, 2019, a work-related incident that resulted in an in-patient hospitalization was not reported timely to OSHA within twenty-four (24) hours, either in person to the OSHA Area Office that is nearest to the site of incident, by telephone to the OSHA toll-free central telephone number, 1-800-321-OSHA (1-800-321-6742), or by electronic submission using the reporting application located on the OSHA public web site at www.osha.gov.    There is no abatement certification or documentation required for this item.
