29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a) On or about 08/21/19, at the Aldi's Store, under renovation, located on 8 Spencerport Road, in Rochester, New York, the employer did enforce the use of fall protection while employees were working on an elevated surface (roof top) 12 feet above a lower level. NO ABATEMENT CERTIFICATION REQUIRED
