OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees On or about October 8, 2019 and prior thereto, the employer stacked pallets and boxes of merchandise on unstable dented and damaged storage racks in the warehouse, exposing employees to struck-by hazards from falling objects in the following areas: a) Aisle 19 - At least 2 dented structural brace support members. b) Aisle 21 - At least 2 dented structural brace support members. c) Bay 34 and 35 rack - At least one rack footing dented and not bolted to the floor. d) Rack #58 - At least one broken and one dented structural brace support members. e) Rack #63 - At least one missing, one broken, and one dented structural brace support members. f) 20MP Racks by the Stop Sign - At least two missing, two broken, and two dented structural brace support members. g) Throughout the warehouse - No plaques with legible maximum permissible unit load and/or maximum uniformly distributed load per level. The Family Dollar Distribution Center was previously cited for a violation of this occupational safety and health standard or its equivalent standard OSH ACT of 1970 Section (5)(a)(1), which was contained in OSHA inspection number 1173557, citation number 1, item number 1 and was affirmed as a final order on 01/10/2017, with respect to a workplace located at 1800 Family Dollar Dr, West Memphis, AR 72301. The Family Dollar Distribution Center was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.176(b), which was contained in OSHA inspection number 1287750, citation number 1, item number 2 and was affirmed as a final order on 06/15/2018, with respect to a workplace located at 1800 Family Dollar Dr, West Memphis, AR 72301.
