29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition. a. On or before November 21, 2019, in the receiving area, the Realift forklift did not have a working parking brake and was not taken out of service. Rural King was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.178(p)(1), which was contained in OSHA inspection number 1357193, citation number 2, item number 1 and was affirmed as a final order on March 7, 2019, with respect to a workplace located at 15190 Veterans Memorial Parkway, Wentzville, MO, 63385. Rural King was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.178(p)(1), which was contained in OSHA inspection number 1272981, citation number 1, item number 1, and was affirmed as a final order on January 16, 2019, with respect to a workplace located at 1900 W. 29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected. a. On or before November 21, 2019, a daily exam of the Realift forklift was not performed to determine if there were any defects that would affect the safe operation of the forklift.
