On 12/3/2019, employees of Alfredo Contreras were installing shingles on a residential building located at 1024 Castleview Court, Cottleville, Missouri.  The employer did not have a Safety and Health program that would have included, but not limited to, training, assignment of responsibility, identifying and controlling hazards.

29 CFR 1926.102(a)(1):  Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents.  On 12/3/2019, employees of Alfredo Contreras were installing shingles on a residential building located at 1024 Castleview Court, Cottleville, Missouri.  Employees were using a Hitachi roofing nail guns without the use of eye protection.

29 CFR 1926.300(b)(2):  Moving Part(s) of equipment exposed to contact by employees or which otherwise created a greater hazard, were not guarded.  On 12/3/2019, employees of Alfredo Contreras were installing shingles on a residential building located at 1024 Castleview Court, Cottleville, Missouri.  Employees were exposed to caught- in hazards while operating two Rolair Air Compressors, Model# 6590HK18.  The guards protecting the starter motors were removed, while in use.

The program did not enable each employee to recognize the hazards of falling and did not train each employee in the procedures to be followed in order to minimize these hazards.  On 12/3/2019, employees of Alfredo Contreras were installing shingles on a residential building located at 1024 Castleview Court, Cottleville, Missouri. The employees were not able to recognize fall hazards and the procedures necessary to reduce or eliminate these hazards.

29 CFR 1926.501(b)(13):  "Residential construction." Employees engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest systems.  On 12/3/2019, employees of Alfredo Contreras were installing shingles on a residential building located at 1024 Castleview Court, Cottleville, Missouri.  Employees were installing shingles approximately 11-17 feet above a lower level. Employees were not utilizing guardrail systems, a safety net system, or a personal fall arrest system.  The employees were observed on the roof of the building without fall protection.  Alfredo Contreras was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1264130, citation number 1, item number 1 and was affirmed as a final order on 2/18/2018, with respect to a workplace located at #2 Tamzine Court, Florissant, Missouri.    Alfredo Contreras was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(11), which was contained in OSHA inspection number 1273480, citation number 1, item number 1 and was affirmed as a final order on 11/28/2017, with respect to a workplace located at 9124 Sappington Road, Saint Louis Missouri.

29 CFR 1926.1053(b)(1):  When portable ladders are used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access.  On 12/3/2019, employees of Alfredo Contreras were installing shingles on a residential building located at 1024 Castleview Court, Cottleville, Missouri.  A portable ladder with side rails extended approximately 1 foot beyond the upper landing surface or edge was being used by employees.  The fall distance was approximately 13 feet to the ground below.  Alfredo Contreras was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 1273480, citation number 1, item number 2 and was affirmed as a final order on 11/28/2017, with respect to a workplace located at 9124 Sappington Road, Saint Louis Missouri.
