29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  a. Located at 9500 Highlands Avenue, Plain City, Ohio: On or about December 11, 2019, the employer failed to ensure that two employees who worked from the second floor level of a new build residential home were protected while they installed OSB sheathing.  The employees were exposed to a fall hazard of approximately 9 feet 10 inches and 14 feet 6 inches respectively, from the top of the joist and unprotected edge without any means of fall protection.

29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. Located at 9500 Highlands Avenue, Plain City, Ohio: On or about December 11, 2019, the employer did not initiate and maintain a safety and health program to ensure hazard detection and correction, while employees performed sheathing work onsite.  Two Employees were unprotected from the top of the second level of a new build residential home.  The fall distance was approximately 9 feet 10 inches from the top of the joist, and 14 feet 6 inches from the unprotected edge to the ground level.
