29 CFR 1926.1053(b)(4): Ladders shall be used only for the purpose for which they were designed. a. On or about May 26, 2020, located at 7328 Yarrow Run, Lot 1202, in Plain City, Ohio, employees were framing a residential home. In order to access a decked floor, employees climbed a Werner stepladder was folded and leaning against a wall exposing the employees to a fall up to six feet.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. a. On or about May 26, 2020, located at 7328 Yarrow Run, Lot 1202, in Plain City, Ohio, employees were framing a residential home without any means of fall protection, thereby exposed to a 7-8 foot fall off the sides of the home or to a 15 foot fall to the basement. Sergio Garcia was previously cited for a violation of this Occupational Safety and Health standard, which was contained in OSHA inspection number 1450218, citation number 1, item number 3 and was affirmed as a final order on January 23, 2020, with respect to a workplace located at 9500 Highlands Avenue, Lot 89, Plain City, Ohio 43064.
