29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: (a) Victor Blanco, on or about February 4th, 2020, at the location of Sublot 9, Tradewinds Dr., Port Clinton, OH, 43452: Employees were using a portable extension ladder to access a roof to perform roofing activities that did not extend three feet above the upper landing surface. Employees were exposed to potential fall hazards of approximately 10 feet while using the ladder and accessing/egressing the roof.

29 CFR 1926.20(b)(1): The employer did not initiate and maintain accident prevention programs as necessary to comply with this part: (a) Victor Blanco, on or about February 4th, 2020, at the location of Sublot 9, Tradewinds Dr., Port Clinton, OH, 43452: Employees were performing roofing activities without the benefit of accident prevention programs to identify and mitigate workplace hazards. Hazards that were unmitigated include falls of approximately 10 feet, lack of fall protection training, and improper ladder set up and usage. Victor Blanco was previously cited for a violation of this occupational safety and health standard [1926.20(b)(1)] which was contained in OSHA inspection number 1428932, citation number 1, item number 1a, and was affirmed as a final order on November 5th, 2019, with respect to a workplace located at Clifton Mill, Sublot MG-0083, North Ridgeville, OH, 44035.
