The employer shall provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace. The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator.    a.) On or about May 26th, 2020, W.G. Stang, LLC did not provide a medical evaluation to determine the employee's ability to use a respirator when employees were required to wear a tight-fitting N95 or 3M half mask elastomeric respirator in the workplace.

29 CFR 1910.134(f)(2): The employer shall ensure that an employee using a tight-fitting facepiece respirator is fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter.    a.) On or about May 26nd, 2020, W.G. Stang, LLC did not ensure employees using a tight-fitting N95 or 3M elastomeric half mask respirator were fit tested prior to initial use of the respirator.

For each employee engaged in a task identified on Table 1, the employer shall fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.    29 CFR 1926.1153(c)(1)(ii)  a) On or about June 2, 2020 W.G. Stang, LLC, had not fully and properly implemented the engineering controls specified for using a STIHL TS 420 handheld power saw, in that, the employer had not ensured employees were using a continuous watering system when cutting residential concrete driveways containing respirable crystalline silica.

The employer shall establish and implement a written exposure control plan that contains at least the following elements: (i): A description of the tasks in the workplace that involve exposure to respirable crystalline silica; (ii): A description of the engineering controls, work practices, and respiratory protection used to limit employee exposure to respirable crystalline silica for each task; (iii): A description of the housekeeping measures used to limit employee exposure to respirable crystalline silica; and (iv): A description of the procedures used to restrict access to work areas, when necessary, to minimize the number of employees exposed to respirable crystalline silica and their level of exposure, including exposures generated by other employers or sole proprietors.   a.) On or about June 2nd, 2020 W.G. Stang, LLC had not established and implemented a written exposure control plan for employees exposed to respirable crystalline silica while cutting residential concrete driveways.
