29 CFR 1926.651(i)(3): Stability of adjacent structures. Sidewalks, pavements and appurtenant structure shall not be undermined unless a support system or another method of protection is provided to protect employees from the possible collapse of such structures. a) On or about April 2, 2026, the employer failed to ensure that employees were protected from crush-by, struck-by or caught in hazards while performing excavation work to install a new 12" water main, including but not limited to undermining in the trench along the south side under the active roadway and where heavy equipment was parked.

29 CFR 1926.652(a)(1): Protection of employees in excavations. Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when: 1926.652(a)(1)(i): Excavations are made entirely in stable rock; or 1926.652(a)(1)(ii): Excavations are less than 5 feet (1.52 m) in depth and examination of the ground by a competent person provides no indication of a potential cave-in. a) On or about April 2, 2026, the employer failed to ensure that a trench box or an alternative protection system was in place prior to employees working in the 6 foot deep excavation, resulting in employees being exposed to cave-in hazards while working on main water line repairs in a public roadway.
