29 CFR 1926.651(j)(2):Employees shall be protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations. Protection shall be provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. a) On or about August 16, 2023, located on a commercial job site, employees were exposed to struck-by and crushing hazards in that the spoils pile for the excavation was not set back at least 2 feet from the edge of the excavation. b) On or about August 16, 2023, located on a commercial jobsite, employees were exposed to struck-by and crushing hazards in that the Deere 85G Mid Size excavator was not set back at least 2 feet from the edge of the excavation.

Ladders shall be used only for the purpose for which they were designed. a) On or about August 16, 2023, employees were not utilizing the Werner extension ladder for the purpose it was intended in that it had been deconstructed and only the top half was being used as access and egress for an open excavation.

Ladders shall be inspected by a competent person for visible defects on a periodic basis and after any occurrence that could affect their safe use. a) On August 16, 2023, the employer did not ensure that a portable extension ladder was adequately inspected prior to use in that employees were using a deconstructed and damaged (bent rung and uprights) extension ladder as the means of access and egress for an open excavation.
