1910.147(c)(4):  Energy control procedure.  1910.147(c)(4)(ii): The procedures shall clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, the following:  29 CFR  1910.147(c)(4)(ii)(B):Specific procedural steps for shutting down, isolating, blocking and securing machines or equipment to control hazardous energy;  a. On or about July 22, 2020, for the 7000 Smith's Mill Road, New Albany, Ohio worksite; the employer failed to develop, document and implement specific procedures for the control of hazardous energy during required employee duties covered by this part. The employer did not have specific procedures for equipment, such as but not limited to the tray erector, the ARPAC Bundler and the Eastey Bundler, for which employees performed covered duties that required the control of hazardous energy. On May 28, 2020, an employee suffered an amputation while performing activities covered by this part, unjamming stock material from the point of operation in the tray erector machine.

29 CFR 1910.147(c)(7)(i):  Training and communication. The employer shall provide training to ensure that the purpose and function of the energy control program are understood by employees and that the knowledge and skills required for the safe application, usage, and removal of the energy controls are acquired by employees. The training shall include the following:  29 CFR  1910.147(c)(7)(i)(A):Each authorized employee shall receive training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation and control.  a. On or about July 22, 2020, for the 7000 Smith's Mill Road, New Albany, Ohio worksite; the employer failed  to train authorized employees in applicable energy sources, the type and magnitude of the energy available, and the methods and means necessary for energy isolation and control, such as machine specific procedures required by this part. Employees performed required duties covered by this part  on machines that included but were not limited to, the tray erector, ARPAC bundler and the EASTEY bundler in the White 9 line area.

29 CFR 1910.147(d):  Application of control. The established procedures for the application of energy control (the lockout or tagout procedures) shall cover the following elements and actions and shall be done in the following sequence:  29 CFR  1910.147(d)(2):Machine or equipment shutdown. The machine or equipment shall be turned off or shut down using the procedures established for the machine or equipment. An orderly shutdown must be utilized to avoid any additional or increased hazard(s) to employees as a result of the equipment stoppage.  a. On or about May 28, 2020, an employee performed duties covered by this part and did not turn off or shut down the tray erector machine in an orderly shutdown as required by this part. During activities that involved unjamming of the machine in the point of operation, the employee suffered an amputation when the machine unexpectedly cycled.  b. On or about August 17, 2020, an employee performed duties covered by this part and did not turn of or shut down the ARPAC bundler machine in an orderly shutdown as required by this part. The machine had an interlocked access door that was used to access to access and change by adding stock material for the equipment, a roll of plastic film. In addition, the access door was used to advance and/or reposition stuck product. The interlock for the access door was bypassed in that the magnetic component on the door was removed and taped to the magnetic component mounted to the housing of the machine.  The machines did not have specific procedures for the control of hazardous energy. In addition, the machines were not isolated from energy sources as required by subparagraph (d)(3) of this part and lockout/tagout devices were not applied as required be or in accordance with subparagraphs (d)(4)(i) through (d)(4)(iii)(B).

29 CFR  1910.303(b)(1):  Examination. Electric equipment shall be free from recognized hazards that are likely to cause death or serious physical harm to employees. Safety of equipment shall be determined using the following considerations:  29 CFR 1910.303(b)(1)(ii): Mechanical strength and durability, including, for parts designed to enclose and protect other equipment, the adequacy of the protection thus provided;  a. On or about August 17, 2020, for the 7000 Smith's Mill Road, New Albany, Ohio worksite; an electrical power supply cable had damaged exterior insulation which was designed to protect the interior live parts. The electrical power supply provided power for a motor component mounted to the ARPAC bundler located in the White 9 Line area.
