29 CFR 1910.95(g)(1): The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels: a) Bottom Bar, Western Bee Supplies, Inc., Polson MT: On or about August 25, 2020, and at times prior, employees were exposed to high levels of noise while working in and around the Bottom Bar. Employee noise levels were measured at 95.3 decibels on an A-weighted scale (dBA) for a sampling period of 460 minutes which is calculated to be 208% of the action level (8-hour time-weighted average action level of 85dBA). A zero exposure was calculated for the remaining 20 minutes, for which sampling did not occur. The employer failed to maintain an audiometric testing program. b) Top Bar, Western Bee Supplies, Inc., Polson MT: On or about August 25, 2020, and at times prior, employees were exposed to high levels of noise while working in and around the Top Bar. Employee noise levels were measured at 91.0 decibels on an A-weighted scale (dBA) for a sampling period of 469 minutes which is calculated to be 114% of the action level (8-hour time-weighted average action level of 85dBA). A zero exposure was calculated for the remaining 11 minutes, for which sampling did not occur. The employer failed to maintain an audiometric testing program.
