29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system: (a)Cardona Construction at 1000 East Teakwood Street, Brandon, SD 57005: On or about and at times prior to October 1, 2020, the employer did not ensure employees were protected from fall hazards. Employees were conducting re-roofing operations without the use of a fall protection system on a 4-in-12 pitched roof on a multi-family residence. This condition exposed employees to a fall hazards of approximately eight feet.

29 CFR 1926.503(b)(1): The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer: (a)Cardona Construction at 1000 East Teakwood Street, Brandon, SD 57005: On or about and at times prior to October 1, 2020, the employer did not ensure a written fall protection training certification record was prepared which included the identities of employees trained, dates of training, and the signature of the trainer or employer. This condition exposed employees to a fall hazard of approximately eight feet. Abatement Note: Paragraph (a) of this section requires that the employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas: (a) The nature of fall hazards in the work area; (b) The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used; (c) The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used; (d) The role of each employee in the safety monitoring system when this system is used; (e) The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs; (f) The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; and (g) The role of employees in fall protection plans; (h) The standards contained in this subpart.
