29 CFR 1926.20(b)(2): The employer did not initiate and maintain effective programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person: (a)Cardona Construction at 3505 East 25th Street, Sioux Falls, SD 57103: On or about and at times prior to August 25, 2025, the employer did not ensure an effective accident prevention program was developed and implemented for the work environment to include regular inspections of the jobsite, materials, and equipment; conducted by a competent person. Employees were exposed to fall hazards from an improperly adjusted ladder, lack of fall protection and/or correctly utilizing fall protective systems, and not utilizing eye protection, while operating pneumatic nail guns when conducting residential roofing activities. This condition exposed employees to a variety of hazards identified on site.

This condition exposed employees to fall hazards. Cardona Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 1715945, citation number 1, item number 1, and was affirmed as a final order on April 9, 2024, with respect to a workplace located at 738 West 10th Street, Sioux Falls, SD 57104.

29 CFR 1926.1060(a):The employer did not provide a training program for each employee using ladders, as necessary, which would enable each employee to recognize hazards related to ladders and train each employee in the procedures to be followed to minimize these hazards: (a)Cardona Construction at 3505 East 25th Street, Sioux Falls, SD 57103: On or about and at times prior to August 25, 2025, the employer did not ensure employees were provided a training program prior to employees utilizing the Multiuse Ladder for access to the roof of the residential property to conduct roofing activities. This condition exposed employees to fall hazards. Abatement Note: The employer shall ensure that each employee has been trained by a competent person in the following areas, as applicable: (a) The nature of fall hazards in the work area; (b) The correct procedures for erecting, maintaining, and disassembling the fall protection systems to be used; (c) The proper construction, use, placement, and care in handling of all stairways and ladders; (d) The maximum intended load-carrying capacities of ladders; and (e) The standards contained in this subpart.
