29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles. On or about 10/05/2020, during the installation of plywood subflooring on the third level of a new townhome unit located at the Foundry Subdivision (Lot #62) in Alpharetta, GA, the employer failed to ensure that employees were protected from possible eye injuries from impact or flying plastic collated debris and/or fasteners. Two employees were using pneumatic nail guns to secure framing and flooring materials without using safety eyewear or facial protection.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: On or about 10/05/2020, employees tasked with installing plywood sub-floor on the third level of townhome unit #62 in the Foundry subdivision in Alpharetta, GA 30009 were not protected from a fall hazard by conventional fall protection and/or devices. Employees were exposed to fall hazard from a height of approximately 23 (+) feet from the third level to the ground level.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: On October 05, 2020, the portable (extension) ladder used by employees during the installation of plywood subflooring on the third level of a new townhome unit located at the Foundry Subdivision (Lot #62) in Alpharetta, GA did not extend 3 feet above the upper landing surface being accesses. The ladder was not secured to the structure to prevent unintended movement during use, and thus potentially exposed employees to a fall approximately 23 feet from the third level to the ground level.
