1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. On or about 11/20/20: Employees were not instructed in the recognition and avoidance of unsafe conditions and the regulations applicable to the work environment to control or eliminate the hazard of being struck by the bucket or boom with in the swing radius the Cat-excavator working at the site. Abatement certification and abatement documentation is required for this violation. The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or video which you will believe will be helpful. The abatement certification sheet is enclosed with the citations(s).
