Located at 11594 Orchid Hill Drive, Plain City, Ohio 43064: On or about December 8, 2020, employees were operating a pneumatic nail gun to frame in the second story of a residential structure being built without utilizing eye protection measures, thereby exposing employees to struck-by hazards. b. Located at 11594 Orchid Hill Drive, Plain City, Ohio 43064: On or about December 8, 2020, employees were operating a portable circular saw to cut wood without utilizing eye protection measures, thereby exposing employees to struck-by hazards. Pasato Construction LLC was previously cited for a Serious violation of this Occupational Safety and Health Standard, 1926.102(a)(1) , which was contained in OSHA inspection number 1411199, citation number 1, item number 2 and was affirmed as a final order on August 14, 2019, with respect to a workplace located at Lot 240, 3561 Switchgrass Court, Hilliard, Ohio 43026.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a. Located at 11594 Orchid Hill Drive, Plain City, Ohio 43064: On or about December 8, 2020, employees were utilizing a Werner 20 foot portable extension ladder to access the second floor of the residential structure. The employer did not ensure that the ladder extended at least three feet above the upper landing surface, thereby exposing employees to fall hazards of approximately 13 feet. Pasato Construction LLC was previously cited for a Serious violation of this Occupational Safety and Health Standard 1926.1053(b)(1), which was contained in OSHA inspection number 1385149, citation number 1, item number 2a, and was affirmed as a final order on April 9, 2019, with respect to a workplace located at 3556 Switchgrass Court, Lot HER 267, Hilliard, Ohio.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): The employer does not protect each employee from the hazard of falling by the use of fall protection systems. The most recently occurred on or about December 8, 2020 on the job site located at 11594 Orchid Hill Drive, Plain City, Ohio 43064. The employer failed to ensure that three employees who were performing framing work from the second story of a residential structure being built were protected from fall hazards while framing in the outer walls of the second floor, thereby exposing them to an approximately thirteen foot fall hazard.
