29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  a. The employer does not protect each employee from fall hazards from elevated heights, by the use of fall protection systems.  The most recent occurred at the Location 11599 Caldwell Court Northwest, Pickerington, Ohio 43147 : On or about April 20, 2023, the employer fails to ensure effective protections against falls as required by the standard. Three employees were observed performing framing work on the second floor of a residential single-family home without any type of fall protection in place. Thereby exposed the employees to falls of up to approximately 12 feet 7 inches to the ground below. 29 CFR  1926.20(b)(1):It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. Location 11599 Caldwell Court Northwest, Pickerington, Ohio 43147 : On or about April 20, 2023, the employer failed to maintain safety and health programs to address site safety including but not limited to fall protection during sheathing/framing activities.   Pasato Construction LLC was previously cited for a violation of this occupational safety and health standard 1926.20(b)(1), which was contained in OSHA inspection number 1608455, citation number 2, item number 1 and was affirmed as a final order on September 22, 2022, with respect to a workplace located at 8521 Chickasaw Way Plain City, OH 43064  Pasato Construction LLC was previously cited for a violation of this occupational safety and health standard 1926.20(b)(1), which was contained in OSHA inspection number 1411199, citation number 2, item number 1 and was affirmed as a final order on August 14, 2019, with respect to a workplace located at IOT 240, 3561 Switchgrass Court, Hilliard, OH 43026.   Pasato Construction LLC was previously cited for a violation of this occupational safety and health standard 1926.20(b)(1), which was contained in OSHA inspection number 1385149, citation number 1, item number 1 and was affirmed as a final order on April 09, 2019, with respect to a workplace located at Lot HER 267, Hilliard, OH 43026.

Location at 11599 Caldwell Court Northwest, Pickerington, Ohio 43147 : On or about  April 20, 2023, the employer failed to instruct each employee in the recognition and  avoidance of unsafe conditions while they performed construction framing work.  Pasato Construction LLC was previously cited for a violation of this occupational safety and health standard 1926.20(b)(1), which was contained in OSHA inspection number 1608455, citation number 2, item number 2 and was affirmed as a final order on September 22, 2022, with respect to a workplace located at 8521 Chickasaw Way, Plain City, OH 43064.
