29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a. The employer does not protect each employee from falling hazards from elevated heights, by the use of fall protection systems.  The most recently occurred on or about July 15, 2022 on the job site located at 8521 Chickasaw Way, Plain City, Ohio 43064. The employer fails to assure effective protections against falls as required by the standard, when five (3) employees are working on a residential second floor, without the use of any type of fall protection systems and are exposed to 20-foot fall hazard. 29 CFR  1926.20(b)(1):It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. On or about July 15, 2022, the employer failed to maintain an adequate safety and health program to address fall protection during sheathing/framing activities.  Pasato Construction LLC was previously cited for a violation of this occupational safety and health standard 1926.20(b)(1), which was contained in OSHA inspection number 1411199, citation number 2, item number 1 and was affirmed as a final order on August 14, 2019, with respect to a workplace located at IOT 240, 3561 Switchgrass Court, Hilliard, OH 43026.  Pasato Construction LLC was previously cited for a violation of this occupational safety and health standard 1926.20(b)(1), which was contained in OSHA inspection number 1385149, citation number 1, item number 1 and was affirmed as a final order on April 09, 2019, with respect to a workplace located at Lot HER 267, Hilliard, OH 43026.
