29 CFR  1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  The employer has not developed and maintained safety and health programs for employees such as, but not limited to, a fall protection program for roofing work activities.  The most recently occurred on March 3, 2021, located at the jobsite at 11121 Cedar Crest Drive, Plain City, Ohio. The employer failed to develop and implement a safety and health program for employees performing roofing construction work.  Jara Construction Inc. was previously cited for Repeat-Serious violations of this Occupational Safety and Health Standard 29 CFR 1926.20(b)(1) which were contained in inspection numbers:  1) 1512315, Cit 3, Item 1, Issued on 02/18/2021. 2) 1479765, Cit 2, Item 1, Issued on 07/08/2020. 3) 1450503, Cit 1, Item 1, Issued on 01/08/2020.  Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including a description of how these steps protect its employees from the fall hazards associated with roofing work activities.

29 CFR  1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  The employer does not protect each employee from the hazard of falling by ensuring the use of fall protection measures.  This most recently occurred on or about March 3, 2021, at the jobsite located at 11121 Cedar Crest Drive, Plain City, Ohio. The employer failed to ensure that employees were protected from falls while installing sub-roof and roofing shingles on a newbuild residential structure, thereby exposing employees to fall hazards of approximately 20-34 feet.  Jara Construction Inc. was previously cited for Willful and Repeat-Serious violations of this Occupational Safety and Health Standard 29 CFR 1926.501(b)(13) which were contained in inspection numbers:  1) 1512315, Cit 2, Item 1, Issued on 02/18/2021. 2) 1479765, Cit 2, Item 2, Issued on 07/08/2020. 3) 1450503, Cit 2, Item 1, Issued on 01/08/2020. 4) 1401142, Cit 1, Item 2, Issued on 08/05/2019. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  The employer did not provide a fall hazard training program for employees exposed to fall hazards.  The most recently occurred on March 3, 2021, located at the jobsite at 11121 Cedar Crest Drive, Plain City, Ohio. The employer failed to develop and implement a fall hazard training program for employees exposed to fall hazards while performing roofing work at the job sites. 29 CFR  1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a. On or about March 3, 2021, and at times prior, the employer did not ensure employees were utilizing eye protection while installing sub-roof and roofing shingles with a pneumatic nail gun. As a result, employees were exposed to struck-by hazards in the eyes.  Jara Construction Inc. was previously cited for a Repeat Serious violation of this Occupational Safety and Health Standard, which was contained in OSHA inspection number 1512315, citation number 3, item number 2, and was affirmed as a final order on 3/15/2021, with respect to a workplace located at 766 Fescue Road, Lot 381, Sunbury, Ohio.  Jara Construction Inc. was previously cited for a Serious violation of this Occupational Safety and Health Standard, which was contained in OSHA inspection number 1479765, citation number 1, item number 1, and was affirmed as a final order on 8/3/2020, with respect to a workplace located at Broadmore Commons Lot 63, Pataskala, Ohio.
