29 CFR  1910.146(d)(2): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not identify and evaluate the hazards of permit spaces before employees entered:  On or about April 15, 2021, the employer did not identify and evaluate all potential hazards in permit spaces within the facility in that the potential mechanical hazard in the coil car pits is not identified in the written program.

29 CFR  1910.146(d)(9): The employer did not develop and implement procedures for summoning rescue and emergency services, for rescuing entrants from permit spaces, for providing necessary emergency services to rescued employees, and/or for preventing unauthorized entry.   On or about April 15, 2021, the employer had not developed and included procedures for summoning rescue and emergency services, for rescuing entrants from permit spaces and for providing necessary emergency services to rescued employees in the permit-confined space program.

29 CFR  1910.146(f): The entry permit that documents compliance with this section and authorizes entry did not identify the required information listed in (f)(1)-(f)(15):  On or about April 13, 2021, the employer did not ensure that entry permits for entry into coil car pits were completed in a manner which identified the entry crew, attendant, supervisor, all potential hazards, how the hazards will be controlled and the rescue services to be used in case of emergency.

29 CFR  1910.1200(f)(6)(i): Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the information required by 29 CFR 1910.1200(f)(1)(i) through 29 CFR 1910.1200(f)(1)(v):  On or about April 15, 2021, the employer did not ensure that totes  with hazardous chemicals such as, but not limited to potassium hydroxide which is contained in  Bonderite C-AK 8686 Alkaline cleaner were labeled and marked with the signal words, hazard statements, pictograms, precautionary statements and name, address, and telephone number of the chemical manufacturer in that a tote containing Bonderite C-AK 8686 Alkaline cleaner retained labeling for Bonderite M-ZN 5854 R A Zinc Phosphate partially covered with paper indicating "8686."
