29 CFR  1926.451(f)(3):Scaffolds and scaffold components were not inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity:  a)  850 Garden Park Blvd, Cherry Hill, NJ, north side of building when under construction:  An adequate inspection by a competent person was not conducted for the approximate 25 ft high by 40 ft wide by 7 ft deep fabricated frame scaffold, masons and laborers were working from without having proper fall protection on all sides, on or about 06/03/2021.   NOTE:  BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASE FILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION OR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.

29 CFR  1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:   a)  North side, northeast corner at 850 Garden Park Blvd, Cherry Hill, NJ - Employees working from the  approximately 40 foot long x 7 foot deep x 21 foot high fabricated  frame scaffold, without fall protection at either end, were working from the mason's platform approximately 21' above the next lower level, on or about 06/03/2021;  b)  North side, northeast corner at 850 Garden Park Blvd, Cherry Hill, NJ - Employees working from the  approximately 40 foot long x 7 foot deep x 21 foot high fabricated  frame scaffold, without fall protection at either end and sporadically for the outside area, were working from the helper's platform approximately 19' above the next lower level, on or about 06/03/2021.  Alexandre Paiva Construction Inc was previously cited for a violation of this occupational safety and health standard or its equivalent standard (name previously cited standard), which was contained in OSHA inspection number 1379420, citation number 2, item number 1 and was affirmed as a final order on 12/09/2019, with respect to a workplace located at 102 Midland Avenue, Elmwood Park, NJ 07407;  Alexandre Paiva Construction Inc was previously cited for a violation of this occupational safety and health standard or its equivalent standard (name previously cited standard), which was contained in OSHA inspection number 1333814, citation number 2, item number 1 and was affirmed as a final order on 12/18/2018, with respect to a workplace located at 102 Midland Avenue, Garfield, NJ 07026;  Alexandre Paiva Construction Inc was previously cited for a violation of this occupational safety and health standard or its equivalent standard (name previously cited standard), which was contained in OSHA inspection number 1176092, citation number 1, item number 2/a and was affirmed as a final order on 02/03/2017, with respect to a workplace located at 102 Midland Avenue, Elmwood Park, NJ 07407.  NOTE:  BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASE FILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION OR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.
