29 CFR  1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  (a) Nature Soy, LLC, dba Keystone Natural Holdings, at 6123 Arapahoe Road, Boulder, CO: On and preceding 7/13/2021, the employer did not administer a continuing effective hearing conservation program when employee noise exposure exceeded the fifty percent noise dose Action Level.  On 7/13/2021, noise monitoring of employees found four production workers in the Tofu, Seitan and Tempeh, and Multi-2 work areas to be exposed to noise whose exposures ranged from 113.5 percent dose to 170.1 percent dose.  The employer had not implemented a noise monitoring program, had not provided employees noise related training, had not provided annual audiograms, and had not evaluated audiograms to determine the presence of standard threshold shifts.  The employer did not have an effective hearing conservation program.  This condition potentially exposed employees to a noise hazard.
