29 CFR 1910.37(a)(2): Exit routes must be arranged so that employees will not have to travel toward a high hazard area, unless the path of travel is effectively shielded from the high hazard area by suitable partitions or other physical barriers. (a) On or about July 17, 2021 during an emergency evacuation, employees exited through door S2 at the direction of their supervisor, as it was the closest exit to the outdoor rally points for the ARG Packaging area, even though the source of the gas leak was at the overhead garage door at location S2, and the exit door not shielded from the hazards of a gas leak and potential fire or explosion.

Employers must install and maintain an operable employee alarm system that has a distinctive signal to warn employees of fire or other emergencies, unless employees can promptly see or smell a fire or other hazard in time to provide adequate warning to them. The employee alarm system must comply with �� 1910.165. (a) On or about July 17, 2021, the Simplex 4100-9311 alarm system was not activated to warn employees of the need to evacuate due to a gas leak near door S2 and the overhead garage door in the ARG packaging area. Many employees reported they could not smell the gas leak immediately due to wearing face masks to comply with the employer's COVID-19 pandemic policy.

For those employers with 10 or fewer employees in a particular workplace, direct voice communication is an acceptable procedure for sounding the alarm provided all employees can hear the alarm. Such workplaces need not have a back-up system. (a) On or about July 17, 2021, the employer had not established and implemented procedures for sounding the Simplex 4100-9311 alarm system to evacuate the building in case of a gas leak that could not be immediately stopped.

29 CFR 1910.38(e): Training. An employer must designate and train employees to assist in a safe and orderly evacuation of other employees. On or about July 17, 2021, the employer had not trained supervisors and other designated employees in the safe and orderly evacuation of the facility during an emergency when the gas pipe to the overhead dock heater in the ARG packaging area developed a gas leak after being struck by a powered industrial truck, in that: (a) Employees exited through door S2 at the direction of their supervisor as it was the closest exit to the outdoor rally points for the ARG Packaging area, even though the source of the gas leak was at the overhead garage door nearest location S2, and the exit door was not shielded from the hazards of a gas leak and potential fire or explosion. (b) Some unidentified employees were observed by their co-workers lighting cigarettes as soon as they exited through the ARG overhead door while the gas leak was occurring. (c) Some employees were left at their workstations and were not notified in a timely manner of the gas leak and the need to evacuate until the gas could be turned off. (d) Kenny Sprow, senior EHS manager, Taylor Guntle, maintenance supervisor, and two maintenance employees monitored the air with four gas meters while they searched for the shut off for the gas. It took approximately 15 minutes to determine they could not find the correct shut off and approximately 45 minutes to trace the gas line from inside the building and on the roof to locate the correct shut off valve. No members of management or EHS employees activated the alarms to have employees evacuate during that time.

29 CFR 1910.145(d)(2): Danger signs. The colors red, black, and white shall be those of opaque glossy samples as specified in Table 1 of Fundamental Specification of Safety Colors for CIE Standard Source "C", American National Standard Z53.1-1967, which is incorporated by reference as specified in Sec. 1910.6. (a) On or about July 17, 2021 a powered industrial truck operator struck the gas piping at the overhead dock heater in the ARG Packaging Area, causing a gas leak. The PIT operator was only aware of the gas leak when they smelled gas, as the employer had not posted Danger signs to notify workers of the overhead hazard in an area where PITs were used to place boxes of supplies on storage shelves.
