29 CFR 1910.132(a): Personal Protective Equipment. Application. Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact. a) On or about October 14, 2023, employer did not ensure that employees were protected by shields and barriers to prevent exposure to the 128 degree Fahrenheit from the electrical ovens when entering the permit confined space to make adjustments to the valves that are controlling the air pressure for each of the hoses located within the Line 2 - ARG VPL Lamination - Ring Puller machine. b) On or about October 24, 2023, employer did not ensure that employees were protected by shields and barriers to prevent exposure to the 128 degree Fahrenheit from the electrical ovens when entering the permit confined space to make adjustments to the valves that are controlling the air pressure for each of the hoses located within the Line 2 - ARG VPL Lamination - Ring Puller machine.

29 CFR 1910.146(c)(7)(iii): Permit-required confined spaces. General requirements. A space classified by the employer as a permit-required confined space may be reclassified as a non-permit confined space under the following procedures: The employer shall document the basis for determining that all hazards in a permit space have been eliminated, through a certification that contains the date, the location of the space, and the signature of the person making the determination. The certification shall be made available to each employee entering the space or to that employee's authorized representative. a) On or about October 14, 2023, employer did not ensure to reclassified Line 2 ARG-VPL Lamination Ring Puller Machine a permit required confined space as a non-permit confined space by documenting prior to entry into the Line 2 ARG-VPL Lamination Ring Puller Machine the basis for determining that all hazards had been eliminated through a certification with the date, the location of the space, and the signature of the person making the determination. No certification was done and made available to each employee entering Line 2 ARG-VPL Lamination Ring Puller Machine on October 14, 2023 and on October 24, 2023.

29 CFR 1910.212(a)(1): General requirements for all machines. Machine guarding. Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips, and sparks. Examples of guarding methods are barrier guards, two-hand tripping devices, electronic safety devices, etc. a) On or about October 14, 2023, the employer did not ensure that machine guarding was adequate to prevent operators from reaching into an ingoing nip point created by the two rotating cone rollers at the Line 2 - ARG Lamination - Ring Puller machine. The purpose off the cone rollers were to detach the rubber hose from the glass windshield, when the hose gets stuck into the cone rollers operator attempt to detach manually while running, exposing operators to pinch points created within the cone rollers. The Fuyao Glass America, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.212(a)(1), which was contained in OSHA inspection number 1375726, citation number 2, item number 4 (c) and was affirmed as a final order on 08/20/2021, with respect to a workplace located at 800 Fuyao Avenue, Moraine, OH 45439.
