Employees shall be required to stand away from any vehicle being loaded or unloaded to avoid being struck by any spillage or falling materials: On August 26, 2021 at a worksite located on W Cumberland Street between Water Street and River Drive in Berlin, WI 54923; an employee in an excavation was standing below the excavator's arm as it unloaded gravel into the excavation exposing the employee to potential spillage or falling material.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems shall be made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection shall be conducted by the competent person prior to the start of work and as needed throughout the shift. Inspections shall also be made after every rainstorm or other hazard increasing occurrence. These inspections are only required when employee exposure can be reasonably anticipated: On August 26, 2021 at a worksite located on W Cumberland Street between Water Street and River Drive in Berlin, WI 54923; daily inspections of the excavation and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins or failure of protective systems when an employee entered and worked in a trench excavation approximately 5 feet 10 inches below ground level.

29 CFR 1926.652(g)(1)(ii): Shields shall be installed in a manner to restrict lateral or other hazardous movement of the shield in the event of the application of sudden lateral loads: On August 26, 2021 at a worksite located on W Cumberland Street between Water Street and River Drive in Berlin, WI 54923; trench shields were installed in a manner that did not restrict lateral movement. Space between both sidewalls of the trench shields and the vertical walls of the trench could result in a shift or tip the trench shields if a cave-in occurred.

On August 26, 2021 at a worksite located on W Cumberland Street between Water Street and River Drive in Berlin, WI 54923; a ladder utilized to access the trench excavation was located outside the trench shields and was not protected from the hazard of cave-ins when an employee utilized the ladder to enter and work in a trench excavation approximately 5 feet 10 inches below ground level.
