29 CFR 1910.146(d)(3): Under the permit space program required by paragraph (c)(4) of this section, the employer did not develop and implement the means, procedures, and practices necessary for safe permit space entry operations, including, but not limited to, the following: (i) Specifying acceptable entry conditions; (ii) Providing each authorized entrant or that employee's authorized representative with the opportunity to observe any monitoring or testing of permit spaces; (iii) Isolating the permit space; (iv) Purging, inerting, flushing, or ventilating the permit space as necessary to eliminate or control atmospheric hazards; (v) Providing pedestrian, vehicle, or other barriers as necessary to protect entrants from external hazards; and (vi) Verifying that conditions in the permit space are acceptable for entry throughout the duration of an authorized entry. a. On or about October 27, 2021, in the Milk Tank Room, Tanks #1-4, the employer did not implement the means, procedures, and practices necessary for safe permit space entry operations, thereby exposing employees to asphyxiation due to limited oxygen, engulfment and/or entrapment.

29 CFR 1910.147(c)(1): Energy control program. The employer did not establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative. a. On or about October 27, 2021, the employer failed to ensure an energy control program consisting of an energy control procedure, employee training and periodic inspections was established for employees performing service and maintenance on machines including, but not limited to Milk Tanks #1-4. The employees were thereby exposed to hazards associated with but not limited to asphyxiation due to limited oxygen, engulfment and/or entrapment.
