29 CFR 1926.62(d)(1)(i):Each employer who has a workplace or operation covered by this standard shall initially determine if any employee may be exposed to lead at or above the action level. a. On or about June 2, 2021 located in the Car Barn of the Trolley Barn Project at or near 1600 Oak Street in Columbus, Ohio, the employer did not conduct sampling to ensure employees were not exposed to lead at or above the action level exposing employees to health hazards from lead exposure. b. On or about June 2, 2021 located in the Power Generation Building of the Trolley Barn Project at or near 1600 Oak Street in Columbus, Ohio, the employer did not conduct sampling to ensure employees were not exposed to lead at or above the action level exposing employees to health hazards from lead exposure.

29 CFR 1926.62(d)(8)(i):The employer must, as soon as possible but no later than 5 working days after the receipt of the results of any monitoring performed under this section, notify each affected employee of these results either individually in writing or by posting the results in an appropriate location that is accessible to employees. a. The employer hired a contractor to perform sampling on the Power Generation Building and the Car Barn which both tested positive for lead. The employer did not inform the affected employees within 5 days of receiving the sampling results exposing employees to heath hazards from lead exposure.
