29 CFR  1910.212(a)(2):General requirements for machine guards. Guards shall be affixed to the machine where possible and secured elsewhere if for any reason attachment to the machine is not possible. The guard shall be such that it does not offer an accident hazard in itself.  a) On or about January 7, 2022, at the facility located at N4993 6th Drive, Westfield, WI 53964, the employer did not ensure that the guard for the Nothum AcuFeeder (SN 45473) was affixed or secured to the machine, exposing employees to amputation hazards.

29 CFR  1910.134(a)(2):A respirator shall be provided to each employee when such equipment is necessary to protect the health of such employee. The employer shall provide the respirators which are applicable and suitable for the purpose intended. The employer shall be responsible for the establishment and maintenance of a respiratory protection program, which shall include the requirements outlined in paragraph (c) of this section. The program shall cover each employee required by this section to use a respirator.  a) At the facility located at N4993 6th Drive, Westfield, WI 53964, the employer did not provide a respirator to each employee when such equipment was necessary to protect the health of such employee. One Operator working on Line 8 was overexposed to the total dust fraction of particulate not otherwise regulated (PNOR), which exceeded the 8-hour time-weighted average (TWA) permissible exposure limit (PEL) of 15 milligrams per cubic meter, and was not provided and required to wear a respirator, while producing product 7206.

29 CFR 1910.1000(a)(2):  An employee's exposure to any substance in Table Z-1, the exposure limit of which is not preceded by a "C", shall not exceed the 8-hour Time Weighted Average given for that substance any 8-hour work shift of a 40-hour work week:   a)  On February 12, 2022, at the facility located at N4993 6th Drive, Westfield, WI 53964, an Operator on Line 8 was exposed to an 8-hour time-weighted average (TWA) of 17.39 milligrams per cubic meter of the total dust fraction of particulate not otherwise regulated (PNOR), approximately 1.15 times the permissible exposure limit (PEL) of 15 milligrams per cubic meter,  while producing product 7206. The exposure level was derived from one sample collected over a 212 minute sampling period with zero exposure assumed for the unsampled period of 268 minutes.

29 CFR 1904.29(b)(1): The employer failed to adequately describe the location and/or provide a descriptive description of a recordable injury and illness on the OSHA Form 300 or equivalent.  Brakebush Brothers, Inc. - N4993 6th Drive, Westfield, WI 53964. On or about November 8, 2021, the employer did not provide the required injury and illness description on the OSHA Form 300 or equivalent for the calendar year 2021.  a) On or about October 14, 2021, while material handling, an employee sustained a injury (Case log Number COMP20211820), which resulted in job transfer or restriction. The case did not contain a complete description of the injury or illness. b) On or about November 6, 2021, an employee sustained a strain (Case log Number COMP20211846), which resulted in days away from work. The case did not contain a complete description of the injury or illness, parts of the body affected, and the object/substance that directly injury or made the person ill.
