29 CFR  1910.28(b)(1)(i):(1) Unprotected sides and edges.  (i) Except as provided elsewhere in this section, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following: (A) Guardrail systems; (B) Safety net systems; or (C) Personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems:  On or about August 10, 2022, at the facility located at N4993 6th Drive, Westfield, Wisconsin, the Spiral Freezer #2 roof platform, near the stairway access, had one unprotected edge 62 inches above the lower roof surface and a second unprotected edge 53 inches above the lower roof surface. The employer had not installed guardrails, safety net system(s) or required personal fall protection system usage to protect employees from the 53 inch and greater fall distances.

29 CFR  1910.28(b)(11)(i):(i) Each employee exposed to an unprotected side or edge of a stairway landing that is 4 feet (1.2 m) or more above a lower level is protected by a guardrail or stair rail system:  On or about August 10, 2022, at the facility located at N4993 6th Drive, Westfield, Wisconsin, the stairway to the Spiral Freezer #2 Roof Platform did not have mid-rails installed on either open side. The stairway landing was 62 inches above the lower roof surface.

29 CFR  1910.29(b)(13):  When guardrail systems are used around holes that serve as points of access (such as ladderways), the guardrail system opening: (i) Has a self-closing gate that slides or swings away from the hole, and is equipped with a top rail and midrail or equivalent intermediate member that meets the requirements in paragraph (b) of this section; or (ii) is offset to prevent an employee from walking or falling into the hole:  a) On or about July 20, 2022, at the facility located at N4993 6th Drive, Westfield, Wisconsin, the ladder access point for the BAC Evaporator Condenser Serial Number U174667302-02-01 work platform did not have a swing gate and was not offset.  b) On or about July 20, 2022, at the facility located at N4993 6th Drive, Westfield, Wisconsin, the ladder access point for the BAC Evaporator Condenser Serial Number U174667302-02-02 work platform did not have a swing gate and was not offset.

29 CFR  1910.119(d)(3)(ii): The employer shall document that equipment complies with recognized and generally accepted good engineering practices:  a) On or about July 11, 2022, at the facility located at N4993 6th Drive, West Field, Wisconsin, the employer had not documented the ventilation systems in Engine Rooms 5A and 5B exceeded the ASHRAE 15 and/or IIAR 2 Normal Intermittent Ventilation, Continuously Operating Ventilation and Emergency Ventilation requirements. b) On or about July 11, 2022, at the facility located at N4993 6th Drive, West Field, Wisconsin, the Line #2 Process Area, the HTRL, HTRS and DC ammonia pipelines for Evaporator #17000115 were not labeled. c) On or about July 11, 2022, at the facility located at N4993 6th Drive, West Field, Wisconsin, in the Line #2 Packaging Area, the HTRL, HTRS and DC ammonia pipelines for the Evaporator #17000118 were not labeled. d)  On or about July 11, 2022, at the facility located at N4993 6th Drive, West Field, Wisconsin, in the Line #4 Processing Area, the HTRL, HTRS and DC ammonia pipelines for each of the two Evaporators were not labeled. e)  On or about July 11, 2022, at the facility located at N4993 6th Drive, West Field, Wisconsin, the Line #9 Marinade Area, the UHRL, UHRS, DC and HG ammonia pipelines for each of the three Evaporators were not labeled. f) On or about July 20, 2022, at the facility located at N4993 6th Drive, West Field, Wisconsin, the Engine Room 4 HTRL pipe line for the High Stage Vessel was not labeled.

29 CFR  1910.119(j)(4)(iv): The employer shall document each inspection and test that has been performed on process equipment. The documentation shall identify the date of the inspection or test, the name of the person who performed the inspection or test, the serial number or other identifier of the equipment on which the inspection or test was performed, a description of the inspection or test performed, and the results of the inspection or test:  On or about July 11, 2022, at the facility located at N4993 6th Drive, Westfield, Wisconsin, the inspection of the significant damage to the insulation protecting a section of the Spiral Freezer #2 Hot Gas ammonia pipeline, which was located outdoors and on the roof, was not documented. The insulation damage included insulation metal jacket tears and seam separations.
