29 CFR  1926.1053(b)(4):Ladder(s) were used for purposes other than the purpose for which they were designed:  On or about December 6, 2021, at jobsite located at 924 Shore Drive, North Palm Beach, FL 33408, an employee was observed using the 10-foot A-framed Werner aluminum ladder and standing approximately on the third upper step closest to the top portion of ladder with the A-frame ladder in a folded position that was propped up against the 9 ft cinderblock wall of the residential home.

29 CFR  1926.1060(a):The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would enable each employee to recognize hazards related to ladders and stairways and train each employee in the procedures to be followed to minimize these hazards.  On or about December 6, 2021, at jobsite located at 924 Shore Drive, North Palm Beach, FL 33408,  the employer did not ensure employee using  an 10-foot A-framed Werner aluminum ladder was trained to recognize hazards related to ladders.
