29 C.F.R. � 1926.20(b)(2): The employer did not initiate and maintain programs to provide for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person:  a.  On the left side of the building, located at 5732 Spring Park Road, Jacksonville, Florida: On or about December 7, 2021, Mediterranean Construction & Roofing, Inc. failed to ensure that frequent and regular inspections by a competent person took place at this jobsite, in that a protective helmet (hard hat) was not utilized by an employee working beneath other employees performing roofing operations above the employee.  b.  On the left side of the building, located at 5732 Spring Park Road, Jacksonville, Florida: On or about December 7, 2021, Mediterranean Construction & Roofing, Inc. failed to ensure that frequent and regular inspections by a competent person took place at this jobsite, in that a 10-foot multi-purpose step ladder was used in the closed position by an employee installing sheathing to an exterior wall.

29 CFR  1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury:  a. On the left side of the building located at 5732 Spring Park Road, Jacksonville, Florida: On or about December 7, 2021, the employer exposed an employee to eye injuries caused by air-born debris and flying objects, in that eye protection was not utilized by the employee, while installing exterior wall sheathing using a pneumatic nail gun.  b. On the right side of the building located at 5732 Spring Park Road, Jacksonville, Florida: On or about December 7, 2021, the employer exposed an employee to eye injuries caused by air-born debris and flying objects, in that eye protection was not utilized by the employee, while installing exterior wall sheathing  using a pneumatic nail gun.  Mediterranean Construction & Roofing, Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1220030, citation number 1, item number 1,  and was affirmed as a final order on July 13, 2017, with respect to a workplace located at  236 Spanish Creek Drive, Lot 388, Ponte Vedra, Florida 32081.

29 CFR  1926.501(b)(1):  Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:   a.  At a 3:12 pitched roof deck of a building, located at 5732 Spring Park Road, Jacksonville, Florida: On or about December 7, 2021, the employer exposed employees to fall hazards ranging from 9 to 20-foot, in that fall protection was not utilized by employees while installing roof deck sheathing.  Mediterranean Construction & Roofing, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1220030, citation number 1, item number 2 and was affirmed as a final order on July 13, 2017, with respect to a workplace located at 236 Spanish Creek Drive, Lot 388, Ponte Vedra, Florida 32081.
